Terms of service
Draft. These terms haven't been reviewed by a lawyer yet. Parts in [square brackets] are still to be filled in.
These terms are an agreement between [legal business name] ("It's Your Bill", "we") and the business that signs up to use It's Your Bill ("you"). By creating an account or using the service you agree to them.
What It's Your Bill does
It's Your Bill is software for people who run media servers (Plex, Emby, Jellyfin, Silo). It sells access to your servers through your own store, takes payments through the payment providers you connect, and adds and removes your customers' server accounts as they pay or stop paying.
We provide the software. We don't host, store, stream or supply any media. Your servers, the content on them, and what you sell are yours.
Your responsibilities
- Your content. You must have the rights to everything you make available on your servers. You must not use It's Your Bill to sell access to content you don't have the right to share. See the acceptable use policy.
- Your servers' own terms. You're responsible for following the terms of the media server software you use. Some, including Plex, restrict commercial use. Check before you sell access.
- Your customers. You're the seller to your customers. You set your prices, provide support, decide on refunds, and answer for what you sell. Your customers' payments go to your own payment accounts (Stripe, Plisio, Venmo, Cash App), not to us.
- Laws and taxes. You're responsible for following the laws that apply to your business, including consumer, tax and data-protection laws, and for any taxes on your sales.
- Your account. Keep your sign-in secure. Turning on two-step sign-in is strongly recommended. You're responsible for what happens under your account.
Plans, trials and payment
- You pay for It's Your Bill by plan (tier), monthly or yearly, by card through Stripe. Prices are on the pricing page.
- A free trial, when a plan has one, turns into a paid plan at its end unless you cancel.
- Plans renew automatically. You can cancel at any time under Your plan. Everything keeps working until the end of the period you've paid for.
- If a payment fails, everything keeps working for 7 days while your card is tried again. After that your business is paused (your store and checkout go offline) until you pay.
- You can change plan under Your plan. Stripe works out the difference for the rest of the period.
- [Refunds: state your refund policy here, for example "Payments are non-refundable except where required by law."]
- We may change prices with at least 30 days' notice. Your current price applies until your next renewal after that.
Your data and your customers' data
We process your customers' details only to run the service for you, as described in the privacy policy. We don't sell it or use it for anything else. Sensitive details are encrypted when stored. We can't see inside your business unless you switch on Support access, which only you can do, for as long as you choose. While it's on we can look but not change anything, and every page we open is listed for you.
Suspension and ending
We may suspend or close an account that breaks these terms or the acceptable use policy, puts the service or other users at risk, or doesn't pay. Where we can, we'll warn you first. You can stop using It's Your Bill at any time. When an account is closed we delete its data within [90] days, except what we must keep by law.
Availability and changes
We work to keep It's Your Bill running, but we don't promise it will always be available or free of errors. We may change or improve features. If we remove something important you're paying for, we'll tell you in advance.
Liability
To the extent the law allows:
- It's Your Bill is provided "as is", without warranties of any kind.
- We aren't liable for indirect or consequential losses, or for lost profits, revenue or data.
- Our total liability to you is limited to what you paid us in the 12 months before the claim.
Nothing in these terms limits liability that can't be limited by law.
Changes to these terms
We may update these terms. We'll show a notice in your dashboard at least [14] days before an important change takes effect. If you keep using It's Your Bill after that, you accept the new terms.
